Triangle Select Program Description

The Triangle Select Program (“Triangle Select”) is a paid subscription program offered by Canadian Tire Corporation, Limited (“Canadian Tire”, “we”, “us”, “our”). Triangle Select subscribers have access to benefits set out in these Triangle Select Subscription Program Terms and Conditions (“Terms and Conditions”) as well as any additional benefits Canadian Tire may make available to Triangle Select subscribers in its sole discretion from time to time.

Eligibility

Triangle Select is available only to existing Triangle Rewards Program members who have reached the age of majority in their province or territory of residence. Triangle Select is intended for personal and household use only. We reserve the right to change eligibility criteria for new members, or for existing members upon renewal, at any time and in our sole discretion. We reserve the right to accept or refuse membership in our sole discretion.

Subscription Term, Automatic Renewal and Subscription Fees

Subscription plans have a term of 12 months except where otherwise specified (the “Subscription Term”). The Subscription Term begins on the day you receive confirmation of your subscription from us. The annual subscription fee is $89, plus applicable tax (the “Subscription Fee”). You will be charged the Subscription Fee using the payment method provided upon enrollment in Triangle Select. We reserve the right to change the Subscription Fee from year to year in our discretion. Except as provided below, your subscription will automatically renew at the end of each Subscription Term for a subsequent 12 month term. You agree that the payment method you have on file with us will automatically be charged the Subscription Fee upon the renewal of your Subscription Term. Your subscription will not be automatically renewed if: (i) You reside in Quebec; (ii) You reside in Alberta and you have not selected automatic renewal on enrollment; (iii) You have logged into your account on the Triangle Rewards web site and have switched-off automatic renewal before your current Subscription Term expires; or (iv) We are unable to process the payment for the Subscription Fee for the renewal Subscription Term.

Triangle Select Benefits

Benefits currently available to Triangle Select subscribers are described below A. Welcome Gift During your first Subscription Term, you will receive a one-time welcome gift of your choice of one of the options presented to you at the time of enrollment. Your welcome gift will be mailed to you. If we offer and you select a voucher as your welcome gift, note that vouchers may only be redeemed in-store and have no cash value. We are not responsible for lost, stolen or damaged vouchers. Not all welcome gift selections will be available to all customers; selection will depend on your location and based on availability. Your welcome gift is non-refundable and cannot be returned to store for credit or exchange. No welcome gift substitutions available. The welcome gift is available to new members only; it is not available if you have previously cancelled a subscription and re-enrolled in Triangle Select or in the event your Triangle Select subscription is renewed. B. Bonus CT Money As a Triangle Select subscriber, you can earn bonus electronic Canadian Tire Money (“CT Money”) as follows:

  • Earn 10X bonus CT Money on all eligible in-store purchases at Canadian Tire, Mark’s/L’Equiper, Sport Chek and Party City.
  • Earn 20X bonus CT Money on the largest eligible purchase made during the Subscription Term. Your largest eligible purchase must have been made in-store at any one of Canadian Tire, Mark’s/L’Equiper, Sport Chek, or Party City. We will apply the 20X bonus multiplier after the end of the Subscription Term.
  • Earn 20X bonus CT Money on eligible purchases made on brands we select and announce to you from time to time. Any additional terms and conditions that apply will be provided at the time of announcement. You can visit triangleselect.com to see which brands are eligible for this bonus offer.

We may add or remove retail stores that are a part of the Canadian Tire family of companies to the list of stores where you can earn any of the above CT Money bonuses. Please check here for the current list of stores. Unless otherwise noted, you can also combine a Triangle Select bonus multiplier offer with other bonus CT Money offers available to Triangle Rewards members. For example, you could combine the 20X bonus CT Money multiplier above with a Triangle Bonus Day offer of a bonus 20X CT Money for a total of 40X bonus CT Money on a qualifying purchase. If you make a qualifying purchase with a Triangle credit card you can also combine the 10X you collect everyday with a Triangle Select bonus multiplier offer. Any bonus CT Money you earn by virtue of being a Triangle Select bonus multiplier will be applied to your existing Triangle Rewards account. If you return an item for a refund and received bonus CT Money when you purchased such item or otherwise in connection with that purchase, such amount of bonus CT Money will be deducted from your Triangle Rewards account. We may cancel any bonus CT Money that has not been properly issued or that we believe has been issued due to fraudulent conduct or conduct that is inconsistent with these Terms and Conditions or the spirit of Triangle Select. We can cancel any bonus CT Money earned if we believe you have not been using your Triangle Select subscription for personal or household purposes or if your purchases are not consistent with personal or household use. Bonus CT Money multiplier benefits are subject to the terms and conditions of the Triangle Rewards Program, which are incorporated by reference into these Terms and Conditions. The Triangle Rewards Program terms and conditions are available online here. Please refer to the Triangle Rewards Program terms for important information about restrictions and exclusions that apply to CT Money. Bonus CT Money multiplier offers are a multiple of the base rate at which a Triangle Rewards member can collect CT Money (current base rate is 0.4%). Bonus CT Money Multiplier offers only apply to purchases made for personal or household use and to quantities consistent with such usage. Additional terms and conditions may apply to Triangle Select bonus multiplier offers and will be communicated in the offer itself. C. Shipping Fees We will reimburse the pre-tax amount of your shipping fees, up to a maximum of $12, for the first five online purchases you make at Canadian Tire during the Subscription Term. Reimbursement will be in the form of CT Money and will be done via a credit to your Triangle Rewards account equal to the pre-tax cost of the shipping fees in question. We will also waive the first $20 of shipping fees on all online purchases made at Mark’s/L’Equiper, and Sport Chek that have an aggregate transaction value of over $50 exclusive of applicable taxes. You will need to enter your Triangle Rewards card number or login to your Triangle Rewards account during checkout and prior to submitting the order to qualify for no/reimbursed shipping fees. All items in the order must be shipped to the same address to qualify. Bulk or overweight purchases and delivery to select addresses are excluded. Examples of excluded addresses include P.O. Boxes, excessive distance or transport limitations and regions/municipalities which require ferry service for delivery. Visit triangleselect.com for a list of excluded addresses. For Mark’s/L’Equiper and Sport Chek, if an item does not qualify for waived shipping fees or the delivery address is excluded you will continue to see shipping charges during checkout. E. Other Triangle Select Benefits We may also offer you additional Triangle Select benefits from time to time. The terms and conditions that apply will be communicated to you before or at the time the benefit is obtained. Some benefits may be offered by a third party supplier (“Supplier”), not us, and will require you to separately enroll and agree to the terms and conditions that apply to those benefits. We are not responsible to you if a Supplier doesn’t deliver a good or service to you or if they discontinue or cancel any benefits offered to you. We do not make any representations or warranties about any benefit provided by a Supplier. Any dispute you have with a Supplier should be directed to such Supplier and will be subject to the terms and conditions that apply to the benefit(s) provided by that Supplier and not these Terms and Conditions.

 

Cancellation

Canadian residents outside of Quebec:

You may cancel your subscription at any time. However, cancellation is only effective as at the end of the Subscription Term and the Subscription Fee is non-refundable.

For Quebec residents only:

You may cancel your subscription at any time. Your cancellation will be submitted for processing the day you make the request and you may be entitled to a partial refund of the Subscription Fee based on the time left in the Subscription Term, less the value of any goods, services or vouchers you have received under Triangle Select. It is possible that the value of the goods, services or vouchers you have received will exceed the pro-rated amount of the Subscription Fee and no refund will be provided. To cancel you will need to call Triangle Select Customer Service at 1-800-226-8473. Refund will be provided as a credit to the payment method used to pay the Subscription Fee.

Termination

We may terminate Triangle Select on 30 days’ notice to you, to be sent via email or such other method as determined by us. In that event, you may be entitled to a refund of the Subscription Fee, less the value of any goods and services you have received under Triangle Select for the current Subscription Term. We may also immediately terminate or suspend your access to Triangle Select if any of the following events occur: (A) you have failed to comply with any of these Terms and Conditions, or we determine that you have abused Triangle Select or have made any misrepresentation or false statement to us; (B) you die; (C) you become bankrupt or insolvent or any bankruptcy or insolvency proceedings are commenced by or against you, (D) you are charged with a “designated offence” (as defined in the Criminal Code (Canada)), (E) we suspect you have engaged in fraudulent activity in connection with Triangle Select, or (G) we have reason to believe that you did not use your Triangle Select subscription solely for personal or household purposes or your purchases are not consistent with personal or household use. Your access to Triangle Select will immediately terminate if we terminate your membership in the Triangle Rewards Program. Termination pursuant to this paragraph may result in the cancellation of all CT Money earned pursuant to Triangle Select without any compensation or other liability to you and we will not refund any or part of the Subscription Fee you have paid to us.

Changes to Triangle Select

We reserve the right to change any aspect of Triangle Select, including any element of the Terms and Conditions, at any time. This includes, but is not limited to, changes to:

  • Program description;
  • Eligibility;
  • Subscription Term and Subscription Fees;
  • Cancelation;
  • Triangle Select benefits;
  • Welcome Gift;
  • Privacy Policy;
  • Transfer and Assignment;
  • Limitation and Liability;
  • Waiver;
  • Governing Law.

In the event of changes to the Terms and Conditions, or if any aspect of Triangle Select is otherwise changed, we will provide you with at least 30 days’ notice before the amendment comes into effect. Such notice will be provided to you by making the amended Terms and Conditions available to view on our website and by sending you written notice to your email address setting out the new clause, or the amended clause and how it read previously, and the date on which the change(s) come into effect. You may refuse the amendment by canceling your subscription without cost or penalty by sending us notice within 30 days after the amendment comes into force at the address or email address provided in the notice. If you do not cancel your subscription by sending use notice within the 30 day window after the amendment comes into force, your continued membership in Triangle Select will constitute your consent to be bound by the new Terms and Conditions.

 

Transfer and Assignment

You may not transfer or assign your subscription or any benefits, including promotion codes, vouchers or discounts.

Limitation of Liability

The laws of certain jurisdictions, including Quebec, do not allow the exclusion or limitation of liability or the exclusion of certain damages. If these laws apply to you, some or all of the below exclusions and limitations may not apply to you: Our total liability, whether in contract, warranty, tort (including negligence), or otherwise, will not exceed the last Subscription Fee you paid. We will not be liable to you under any circumstances for any indirect, consequential, punitive or exemplary damages of any kind, whether or not your claim is made under these Terms and Conditions or otherwise. This limitation of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your subscription.

General

These Terms and Conditions, as amended by Canadian Tire from time to time, constitute the entire agreement between you and Canadian Tire with respect to Triangle Select. On occasion, Canadian Tire, our various businesses within the Canadian Tire final of companies, Partner Locations pursuant to the Triangle Rewards Program and any marketing partners may communicate special offers, information and services to you by email, text message (standard text message and data rates may apply) or other communication preferences selected by you using the contact information you have provided. If you do not wish to receive these offers, you may so indicate on the Triangle Rewards Website or by calling Triangle Select customer service at 1-800-226-8473. Please note that even if you have opted out of receiving marketing communications, we may still contact you for the purposes of administering your subscription and sending you transaction or operational messages. Any waiver by Canadian Tire of any of these terms and conditions at any time does not mean the Canadian Tire cannot rely on these terms and conditions at any subsequent time. Not delay or omissions by Canadian Tire in exercising any right or remedy hereunder shall operate as waiver thereof or of any other right or remedy. You are responsible for informing Canadian Tire of any change to your personal information (e.g. name, address, email, etc.), by visiting the Triangle Rewards Website or by calling Triangle Select customer service. Canadian Tire reserves the right to terminate your participation in Triangle Select if Canadian Tire has inaccurate or incomplete information about you. Enrolment in Triangle Select constitutes acceptance of these Terms and Conditions and you consent to the collection and use of personal information in accordance with the Canadian Tire Privacy Charter as amended from time to time. If any provision of these Terms and Conditions is invalid or unenforceable, such provision will not affect the validity and enforceability of any of the remaining Terms and Conditions. Participants are responsible for any taxes, duties or other charges associated with their participation in Triangle Select. All dollar amounts in these Terms and Conditions are in Canadian dollars. The place of this contract is your address of residence as provided to us at the time of your enrollment. Governing Law

These Terms and Conditions shall be governed by the laws of the Province where you reside and the laws of Canada applicable in that Province.

Language
